Michigan regulates life settlements under the Viator Act, which provides consumer protections for policyholders:
Rescission window: You can cancel a viatical/life settlement within 30 days of signing or 15 days after receiving proceeds, whichever is less.
Required disclosures (before signing): Alternatives (e.g., accelerated benefits), potential tax issues, creditor exposure, possible impact on government benefits, your rescission right (30/15), and when/where funds will be available.
Escrow & payout timing: Provider must place proceeds in escrow upon receiving transfer documents; the bank must release funds to you immediately after the insurer acknowledges the transfer. (Statute says “immediately,” not “within 3 business days.”)
Consent & privacy: Contract must include your written consent, acknowledgement you understand the policy/contract, and a medical-records release that the provider must keep confidential. Michigan Legislature
Insurer notification & alternatives: Offers to purchase must be sent to the insurer, who may advise you about other options under the policy.
Enforcement: The Insurance Commissioner can bar providers, levy fines, and order repayment for violations.
